Terms of Service

These Terms of Service ("Terms") govern your use of the Campaign Engineering platform (“Application”). By signing up to, installing, or using the Application, you agree to be bound by these Terms. Please review them carefully before proceeding.

1. General

By using the Application, you agree to comply with these Terms and any applicable laws. If you do not agree, do not use the Application.

2. Definitions

The “Application” refers to the software provided by Campaign Engineering, owned by The Campaign Company Limited, accessible via campaign.engineering, sub-domains, and related websites.

3. Data Protection

Any personal information you provide when using the Application will be used in accordance with our Privacy Policy, which complies with both US and New Zealand privacy laws.

4. Campaign Engineering Platform

The Application allows you to access certain functionality related to direct advocacy, including sending emails to government officials, elected officials, and other stakeholders. Your use of the Application must also comply with any third-party terms, such as email services or third-party software integrated with Campaign Engineering.

5. Proprietary Rights and Licence

5.1. All trademarks, copyright, database rights, and other intellectual property rights in the Application and its underlying software code are owned by The Campaign Company Limited or its licensors.
5.2. Campaign Engineering grants you a non-exclusive, royalty-free, revocable license to use the Application for your business, non-profit, or personal purposes in compliance with these Terms.

6. Conditions of Use

6.1. You agree not to:

• Distribute copies of the Application;
• Attempt to reverse engineer, disassemble, or modify the Application; or
• Create derivative works based on the Application without express permission.

6.2. The Application is made available to you for a fee based on your selected plan. Non-payment of fees will result in suspension of your access.

6.3. You agree not to use the Application for any of the following prohibited purposes:

• Sending unsolicited mass emails (spam);
• Sending commercial emails;
• Failing to comply with email recipient requests to be removed from lists;
• Misrepresenting the sender of an email;
• Engaging in activities such as "pyramid schemes," "chain letters," or unauthorized advertising;
• Harvesting email addresses;
• Sending emails that contain harmful software; or
• Sending emails that contain offensive content – including (but not limited to) any content that is deemed by Campaign Engineering as obscene, discriminatory, defamatory, or otherwise infringe on the rights of others.

6.4. Campaign Engineering reserves the right to block emails from being sent if one or more recipients request removal from your campaigns.

7. Accounts

7.1. You must provide accurate and current information when creating an account. Failure to do so may result in account suspension or termination.
7.2. You are responsible for safeguarding your account password and any activity that occurs under your account. Notify us immediately if you suspect unauthorized access.
7.3. Usernames that are offensive, obscene, or infringe on the rights of others are not permitted.

8. System Requirements

8.1. The Application may require updates to add new features or maintain compatibility with other software.

9. Termination

9.1. Campaign Engineering may terminate your access to the Application at any time without notice. Upon termination, your license to use the Application will immediately cease.
9.2. Upon termination, you must stop using the Application and delete any copies of the software in your possession.

10. Limitation of Liability

10.1. Campaign Engineering is not liable for any direct, indirect, special, or consequential damages arising from your use of the Application, including loss of profit, data loss, or service disruption.
10.2. Campaign Engineering is not responsible for any damage or disruption to third-party platforms or services integrated with the Application, including email services or third-party databases.
10.3. Nothing in these Terms limits Campaign Engineering’s liability for death or personal injury caused by negligence or fraud, or any other liability which cannot be excluded by law.

11. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes arising from the use of the Application will be resolved in the courts of New Zealand.

12. Prohibited Uses

This product must not be used by individuals, campaigns, or organizations that:

• Incite violence or promote or propagate illegal content;
• Discriminate based on race, religion, gender, or other protected categories;
• Promote misinformation or slander;
• Engage in human trafficking, forced labour, or arms trafficking;
• Oppose democratic governance or transparency.

Campaign Engineering reserves the right to terminate access if it becomes aware of violations of these terms.

13. Updates to These Terms

We reserve the right to update or modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting the revised Terms on our website. Your continued use of the Application after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for any updates or changes.
